Perhaps. But are judges ready to overrule Harvard, if Harvard says the students are plagiarists and the professors aren't? Are judges ready to rock the DEI fraud to its core? At least so far, the faculty who have been accused are all deeply involved in DEI initiatives and, just as important, benefited from DEI themselves.

Many judges are Ivy League products, and that's likely to be especially true in New England where these cases would be filed. I don't think they have the integrity to damage Harvard's reputation that much. Think for a moment about the Colorado Supreme Court taking Trump off the ballot, the decision that the Supreme Court reversed 9-0. Every one of those judges was a Democrat. But all of the judges who voted to take Trump off were Ivy League educated. The ones from other schools voted to keep him on. Look who had respect for the law and the Constitution and look who didn't.

I don't have much of a track record for predicting the future, but we're likely to be looking to Ivy League federal judges to have integrity and respect for the law to rule for the students in these cases. I don't think they have it. I think the students are likely to lose.

Expulsion or other sanctions for plagiarism are easily justified by a look at the student's submitted work. Making a case that the sanction(s) are wrongful because the University forgave others for similar is likely to be hard. Students sign onto a honor code or to abide by the precepts of a student handbook. I assume faculty do as well at some level, perhaps by contract, but there is enormous pressure to sweep this stuff under the rug. Only the internet has thrown sand into those gears. Buffett was speaking of a different issue but his quote is apt.

"When the tide goes out you discover who is swimming naked."
