I believe Virginia is now considering refusing to give any white owned company any government contract for goods or services under $100,000 unless no minority/female owned company can be found. I say "considering" but it may be that Spanberger has already issued an "executive order" to violate the Constitutional guarantees of Equal Protection.
The problem with lawsuits is they take forever and the defendants are usually well heeled governments, universities, or corporations and make the aggrieved litigate all the way to the Supreme Court to have their rights vindicated. Allan Bakke was denied admission to UC Davis in 1973. His case wasn't decided by the Court until 1978. The only practical way to end discrimination is to stop discriminating or, failing that, to impose VERY severe penalties for doing so.
We need an absolute guarantee of equal protection. The only way to get there is to eliminate any mention of 'protected characteristics.' As soon as one characteristic is protected, the others are by definition discriminated against by not being protected, as is argued here:

She was talking about being shot by a white cop who, according to the left, routinely shoot blacks all over the country simply for being black. Politicians now talk about the need for more police but no one wants to be a cop in cities like Chicago anymore due to the extreme danger they now face after being demonized as racist murderers by the left. Why would the white left in the media and Democratic Party want to demonize white people? To instill shame and white guilt which would generate support for things like reparations and equity aka race based equal outcomes. And these are the same people now demonizing ICE.

I've been here for all that time, and I think this synopsis hits at the heart of all of it. I'll read "Redefining Racism" as soon as I can. There is a market of well connected and wealthy women/black people who are made "owners" of companies in order to qualify for these loans and similar government set asides. Every occasion a new contract was to be awarded for engineering and technical support of DoD avaiation programs, it could be assumed that if the dollar value threashild was ynder the “cap” value for a Small Business bidder, that the contract would go to a 8a company. There was no way a gov t contracting office was going to go through the turmoil of awarding the best equipped bidder, knowing that the same afternoon the contract would come under legal dispute by all the 8a category bidders. Over the past 30 years it just became assumed that contract would go to a woman/minority business. No agency head was going to push back against a practice ALL their predecessors had turned a blind eye to.
the obvious answer was to get a token female or minority to be the front”man” to list in the ownership criteria. if left to only companies that genuinely had expertise AND could meet the special dispensation criteria, the programs that maintain our military readiness would not be viable.
